Divorce

Divorce is the legal dissolution of marriage which occurs in New York State upon a qualified Judge or Referee of the Supreme Court signing a Judgment of Divorce. A Judgment of Divorce must lay out how a couple intends to divide child custody and child support, divide property and debt (known as equitable distribution), whether one party will pay spousal support or maintenance to the other, as well as other provisions. Although a Judge or Referee must sign a Judgment of Divorce, most couples will never physically appear in court as the vast majority of divorces settle out of court.
